Regulations governing a promotional benefit offering a 10% discount on vacation reservations using a benefit coupon for E-DAN club members who are celebrating their birthday
The terms and conditions set out in these Regulations will apply to the Benefit (herein: the "Regulations", the “Member benefit”)
1. The Site and the hotels participating in the promotion.
1.1 The Company’s internet site - www.danhotels.co.il (hereinafter, the "Company Website").
1.2 List of hotels participating in the Benefit - all hotels operated by the Company in Israel (excluding India).
2. Definitions
2.1 The Benefit will be given by Dan Hotels Ltd., P.c. No. 52-002357-3 (hereinafter, the "Company").
2.2 These Regulations shall apply in addition to the company's website terms and conditions and the company's club membership terms and conditions of E-DAN Members Club (hereinafter: the "Company Club/E-DAN Club").
2.3 "Participant" – a valid E-DAN Club member, including a newly joined Club member, as long as they meet the conditions for receiving the Benefit as detailed in Section 4 below.
2.4 The "Benefit" – 10% discount (an additional discount – beyond the regular club discount) for booking a vacation in the Gregorian calendar month in which the Participant's birthday falls based on the Participant's date of birth. The reservation will be made on the Company Website by entering a designated coupon code that will be sent to the Participant in a specific email message from the Company, and will apply to one of the hotels shown on the list of hotels which are participating in the promotion.
3. Validity of the Benefit
The Benefit will apply to hotel stays made during the Gregorian calendar month in which the Participant's birthday occurs, based on availability. The Company reserves the right to discontinue and/or curtail and/or extend the promotion at any time. It is clarified that if the date of birth changes for any reason, the option to exercise the Benefit will not be given more than once in any calendar year.
4. Preconditions for receiving the Benefit
4.1 A Participant will be entitled to receive the Benefit subject to the fulfillment of all the following preconditions (hereinafter, the "Conditions for Receiving the Benefit"):
4.1.1 The Participant is a member of the E-DAN Club (hereinafter, a "Club Member"), who has confirmed the receipt of mail from the Company (i.e. - a Member who has consented to receive advertising and mail from the Company).
4.1.2 The Participant has entered his birthday (based on his date of birth) in the personal area designated for Club Members on the Company Website/in person at the Company’s Clubs Department (hereinafter, the "Clubs Department"), at least sixty-five (65) days prior to his birthday (hereinafter, the "Qualification Period").
4.2 It is emphasized that the date of birth entered on the system must be only that of the Club Member (and not that of his partner, son, etc.). A breach of the aforesaid will constitute a breach of these terms and conditions. In addition, the Benefit may be exercised solely by the Club Member (who received the Benefit coupon code).
4.3 A Club Member who meets the conditions set forth in Section 4.1.1 above but does not meet the condition set forth in Section 4.1.2 above shall be granted a one-time opportunity to receive the Benefit coupon by entering their date of birth in the personal area of the Company Website within no more than seven (7) days from the date of receiving a dedicated newsletter, which will be sent only once upon the initial launch of the Benefit. After the expiration of this period, it will only be possible to update the date of birth with the Clubs Department in writing, by sending an email to clubs@danhotels.com, along with a copy of the Participant's ID, provided that they have met the timelines of the Qualification Period, as defined above.
4.4 For the avoidance of doubt, it is hereby clarified that a Participant who has not entered their date of birth, has not entered it correctly, and/or has not updated their date of birth during the Qualifying Period, as defined above, will not be eligible to receive or redeem the Benefit. That is, if the Participant has not entered and/or updated their date of birth within at least sixty-five (65) days up to and prior to the date of birth, the Participant will not be entitled to receive the Benefit coupon code or redeem it, all subject to the provisions of Section 4 and all other conditions of these Regulations.
5. Conditions for redeeming the Benefit and receiving the Benefit coupon
5.1 Approximately sixty (60) days before the Club Member's date of birth (as entered when registering for the Company's Members' Club and/or when updating the details as stated above in these Regulations) an email will be sent to a Participant who satisfies the preconditions for receiving the Benefit, as detailed in section 4.1 above, to which a coupon code will be attached to redeem the Benefit (hereinafter: the "Benefit Coupon").
5.2 The Benefit Coupon can be exercised by booking a Vacation on the Company Website only at one of the hotels that are participating in the Benefit in the Gregorian calendar month in which the Participant's birthday occurs. When making the reservation, it will be necessary to log-in to the Club’s personal area (hereinafter, "Reserving the Vacation").
5.3 The coupon code shall be entered in a designated field on the "Order Details" page and not on the main purchase page. Instructions for redeeming the birthday benefit code are attached as Appendix A.
5.4 In the context of Reserving the Vacation, the Benefit may be exercised in a single reservation for up to two (2) rooms at most and for a period of up to three (3) nights only for each room. For the avoidance of doubt, exercising the Benefit for the reservation of two (2) rooms will only be possible within the same reservation and during the same stay period.
5.5 When making the reservation and during check-in at the hotel, the Participant must be present in order to exercise the Benefit by presenting an ID, passport, or driver's license that includes the Participant's date of birth. A Participant who arrives without such identification document will have their reservation updated in a manner that removes the Benefit, and the prices will be adjusted according to the prevailing accommodation rates for the general public during the stay period. The Participant waives any claim and/or suit regarding the said price adjustment.
5.6 The Benefit and the exercise of the Benefit coupon are personal to the Participant and may be used once only by each Participant.
5.7 The Benefit may be redeemed only if all the conditions set forth in these Regulations are met. For the avoidance of doubt, the Benefit cannot be redeemed retroactively.
5.8 The Benefit cannot be assigned and/or transferred to a pre-existing reservation. If a Participant has an existing Vacation reservation (hereinafter: the "Pre-existing Reservation"), and wishes to redeem the Benefit coupon on the same dates as the Pre-existing reservation and does not make a new Vacation reservation, he will be required to cancel the Pre-existing Reservation and make a new Vacation reservation in accordance with the provisions of Section 5.2. above and subject to compliance with all the conditions in these Regulations. It is clarified that such cancellation of an Pre-existing Reservation and the making of a new Vacation reservation may incur a revision/change in prices. The Participant waives any claim and/or demand and/or suit in this regard.
5.9 It is clarified that the exercise of the Benefit must be by way of making a reservation on the aforementioned website. Accordingly, in no event will it be possible to exercise the Benefit when arriving at the hotel with a Pre-existing reservation and/or while staying at the hotel and/or at another time.
5.10 The Benefit will be applied to the final room price after deducting the Club Member discount from the price established on the Company Website price list.
5.11 It will not be possible to exercise multiple benefits and/or promotions, other than the exercise of the Benefit in addition to the established Club discount (which, as of the date of updating these Regulations is 8%) and after deducting the value of the established Club discount.
5.12 The Benefit will be given to private customers only.
5.13 Making additions to a Vacation in the context of which the Benefit coupon has been redeemed (such as: changing/upgrading a room, adding a guest, adding a meal, etc.) and receipt of a reservation confirmation - will be enabled by an additional payment (to which the Benefit will not apply) and via the telephone reservation center only. For the avoidance of doubt, it is clarified that the Benefit will apply to further components which are added during the reservation process (before it has been completed and a reservation confirmation has been received).
5.14 If a Participant wishes to change the date of the Vacation by booking at another Company hotel, the mechanism to do so will be in accordance with section 5.7. above, i.e. – by cancelling the Participant’s reservation, only through the Company's reservation center by phone at 1-700-50-50-80, and making a new Vacation reservation in accordance with section 5.2. above, and subject to complying with all the conditions set out in these Regulations. It is clarified that such cancellation of an existing reservation and making a new Vacation reservation may lead to an update/change in prices. The Participant waives any claim and/or suit in this regard.
5.15 The Benefit is personal and non-transferable. Accordingly, the Participant must be present in person at the place of accommodation which is the subject of the Vacation reservation.
5.16 No monetary credit or refund will be given if the Benefit is not exercised.
5.17 The Company reserves the right to change the conditions and period of the Benefit and/or to terminate and/or cancel it in accordance with the provisions of the law and at its sole discretion.
5.18 The Participant alone is responsible for the exercise of the Benefit, and he waives any claim and/or suit and/or demand against the Company in connection with the his non-exercise of the Benefit for any reason whatsoever, including waiving any claim for compensation in respect thereof, exercising the Benefit at a different time (because it cannot be exercised on a date other than the dates delineated in these Regulations), etc.
6. Updating the Date of Birth
6.1 It is agreed that the Participant is responsible for ensuring that his date of birth, based on his official Gregorian date of birth, is registered and/or correctly registered with the Company, by checking on the personal area of the Company Website. Updating the date of the birth will be done by a written application, together with a photocopy of an ID card and/or passport, to the Clubs Department, at the email address clubs@danhotels.com .
6.2 In no event will the Company be responsible for non-receipt of the Benefit, non-receipt of a notification or any consequence of a failure to revise the Gregorian date of the Participant's birthday based on his date of birth and/or a failure to update the Participant's details during the Qualifying Period, as defined above, and/or at any other time and/or for any other reason.
7. The Effective discount
7.1 It is clarified that the Benefit will be calculated on the final price payable, after deducting all benefits and/or coupons. Thus, for example, if a Participant redeems an established Club discount of 8% in the context of a Vacation reservation, the price of the Vacation will be revised by deducting the 8% and only then will the further calculation of the Birthday Benefit (10%) be applied, i.e. an “effective discount” of 17.2%.
8. Miscellaneous
8.1 Neither the Company nor anyone acting on its behalf is and/or will be responsible for any technical malfunction relating to the correct operation of the Internet, the electricity system, and/or any other infrastructure or communication resources, or any of their components, and will not be liable for interruptions, outages, disconnections, damages, expenses, loss of profit, etc., which may be caused to the Participant in connection with the Benefit, directly and/or indirectly, and will not bear any responsibility for any technical malfunction relating to the operation of the Company's website systems, nor do they undertake that the services provided thereon, in whole or in part, will be provided as required, without interruptions and without faults, and/or that they will be proof against unauthorized access to computers and/or the Company Website and/or against malfunctions, damage or malfunctions to the software, hardware and lines of communication lines, of the Participant and/or the Company Website and/or those of any of their suppliers and/or anyone acting on their behalf. It is hereby clarified that the Company is not responsible for any act or omission by the Participant and/or anyone acting on his behalf and will not be responsible for any damage and/or loss and/or expense incurred by the Participant and/or any third party as a result of the aforesaid.
8.2 If a malfunction of any kind occurs, including but not limited to, in the communications network and/or on the Company Website, which may directly and/or indirectly affect the correct process of exercising the Benefit in any way, and/or which prevents anyone who is interested in participating - the Participant will not have any claim and/or demand and/or suit against the Company. The Company will not bear and will not be required to bear, any liability, and will not compensate and will not be required to compensate, any Participant, for any expense and/or direct and/or indirect damage, including consequential damage, incurred as a result of his participation in the operation.
8.3 Participation in the Member benefit is the sole responsibility of the Participant.
8.4 Neither the Company nor anyone acting on its behalf will be liable for any damage and/or harm and/or loss and/or expense incurred in connection with participation or non-participation in the Member benefit and these Regulations.
8.5 In the event of a contradiction between the provisions of these Regulations and any other publication of or reference to, the Benefit, written or oral, the provisions of these Regulations shall prevail.
8.6 In any case of dispute in connection with the Member benefit and/or its rules and/or conditions and/or the provisions of these regulations, the Company's management will decide on the matter and its decision will be final and unappealable.
8.7 Participation in the Member benefit constitutes agreement to the provisions of these Regulations and an undertaking that, subject to and in accordance with the provisions of these Regulations, the Participant and/or anyone acting on his behalf will not have any claim and/or demand and/or suit against the Company and/or any of its employees and/or anyone acting on its behalf.
8.8 These Regulations incorporate all applicable conditions relating to the Member benefit.
8.9 For the purpose of convenience only, these Regulations are drafted in the masculine gender but are intended for both genders.
Appendix A – Instructions for Redeeming Your Birthday Discount Code
Please note: The promo code field on the room search page of the Dan Hotels website is not intended for entering the birthday benefit code.
1. After receiving the discount code via email, visit the Dan Hotels website: www.danhotels.com.
2. Log in to your E-DAN Club Member account.
3. On the reservations page, select your desired hotel and dates, then click "Check Rates".
4. After choosing your preferred rooms, click "Book Now".
5. On the reservation details page, enter your birthday discount code in the designated field and click "Redeem".
6. Proceed with the booking process until the reservation is complete.
